1. Introduction

Welcome to Cart Call ("we," "our," or "us"). By installing and using the Cart Call Shopify Application ("Service"), you agree to be bound by these Terms of Service. Cart Call provides an automated AI voice agent designed to recover abandoned carts on Shopify stores.

2. Merchant Responsibilities and Compliance

As a merchant using Cart Call, you are strictly responsible for complying with all local, state, federal, and international communication laws regarding automated phone calls, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA) in the United States.
  • The General Data Protection Regulation (GDPR) in the European Union.
  • Telemarketing Sales Rule (TSR) and Do Not Call (DNC) registry requirements.

Express Consent: You must ensure that your Shopify checkout clearly obtains prior express written consent from your customers to receive automated voice calls regarding their abandoned checkouts. Cart Call is not liable for calls made to customers who have not explicitly consented.

3. Billing and Subscriptions

Cart Call operates on a subscription and pay-for-usage model. All billing is handled directly through the Shopify Billing API. You will be charged a monthly base fee, plus usage charges for AI voice minutes consumed (e.g., $0.15/minute) beyond your plan's included limits.

4. Expected Use and Quiet Hours

You are required to configure "Quiet Hours" within the Cart Call dashboard to ensure AI calls are not placed during restricted nighttime hours in the customer's local timezone. Misuse of the platform or generating excessive spam complaints may result in immediate suspension of your account.

5. Limitation of Liability

Cart Call provides the platform "as is". We do not guarantee a specific conversion rate or recovery revenue. We are not liable for any claims, fines, or damages arising from your failure to obtain proper calling consent from your customers.
